[01] FAQ On Policy & Regulations

Q1: Is the MM2H program an emigration program ?

NO. The MM2H program is not an emigration program where you can eventually obtain a citizenship (new nationality, new passport), permanent residency (PR) or Green Card. The MM2H program only provides foreigners with a renewable Long-Term Residency Pass with Multiple-Entry Visa for 5, 10, 15, or 20 years to stay and live in Malaysia.

Q2: After obtaining the MM2H Visa, am I qualified to apply for a permanent residency (PR) status in Malaysia?

NO. Currently it is not possible to obtain a permanent residency (PR) through the MM2H Programme in any category.

Q3: Who can apply for the MM2H program?

The MM2H Program is open to all individuals worldwide (except Israel and North Korea) who are 21 years or above (for SEZ/SFZ category) or 25 years or above (for Platinum/Gold/Silver category). It is mainly designed for retirees who wish to retire/live in Malaysia long-term, investors who wish to invest or purchase property abroad, young parents who want their children to study overseas in an English-based international school system, or anyone who simply seeks for a long-term residency visa in a foreign country in Asia as their second home.

Q4: Is it easy to apply for the MM2H Program?

YES. As long as you meet the financial requirements and have no criminal record, you can apply. Select and appoint a licensed MM2H agent to represent you to submit your application. Within 3-6 months, you will get your Approval Letter. Once approved, make a trip to Malaysia to open a bank account in Malaysia and deposit the required amount into a fixed deposit account to receive a multiple entry visa valid for 5, 10, 15, or 20 years (depending on category). It is one of the simplest long-term residency pass programs in the world.

Q5: Do I need to give up my current nationality / citizenship after participating in the MM2H program?

NO. The MM2H program is a long-term Residency Pass/Visa program, and it does not require applicants to change their nationality. After obtaining the MM2H Visa, the participants will continue to retain their current nationality/citizenship, and there will be no impact on their home country’s residency or nationality status.

Q6: Can I enter or leave Malaysia at any time during my MM2H participation? Any maximum days per visit constraint in my MM2H Visa?

YES. MM2H participants can enter and leave Malaysia at any time and without any restrictions in the maximum days of stay per visit (such as 30 days per visit for tourist Social Visit Pass), during the MM2H Visa validity period. They enjoy the similar privileges of entering, staying and leaving Malaysia, just like the citizens, permanent residents or foreign residents with long term residency pass in Malaysia. 

Q7: Do I need to report to the authorities where I stay in Malaysia during MM2H participation?

NO. The Malaysia Government does not track where MM2H participants stay. MM2H participants are not required to report their residence in Malaysia to the Authorities, such as MOTAC or Immigration Department. 

Q8: What happens if the main applicant passes away during the MM2H participation?

With the new MM2H policy (introduced in 2024), if the main applicant passes away, the MM2H Visa can be “transferred” to the next-of-kin (must be above 21 years old), who is usually the spouse or designated dependent, allowing the family to continue staying & living in Malaysia under the MM2H program. Contact us immediately for assistance if this incident happens. 

Q9: I applied for the MM2H Silver category. What happens to my MM2H Visa after five years?

After the first 5 years of your MM2H Silver Visa has expired, you can apply for renewal for another five years, and subsequently every five years thereafter. As long as you maintain at least 50% of the Fixed Deposit in the bank, and have no violation to any conditions as set forth in your approval letter, your renewal is straightforward and procedural in nature. You will need to resubmit some documents and pay for a renewal fee of RM 1,500 (for the whole family) to the Government. Contact us, at least 6 months before your 5-years Visa expiry, and we will assist you with the renewal process.

Q10: Will the MM2H policy change again in the future and affect the existing MM2H participants? *

The New MM2H Program has been introduced and relaunched by the Malaysia Government in mid 2024. Since then, there is no major changes or overhauls in the key conditions/requirements in the policy framework, with the exceptions of certain fine tuning and adjustments to the operational details of the program, such as the documents required for application. 

[02] FAQ On Requirements

Q1: Can I upgrade or downgrade my MM2H category after I have obtained my MM2H Visa?

NO. Currently there are no upgrade or downgrade paths specified by MOTAC for different MM2H categories (upgrade from Silver > Gold > Platinum, or vice versa for downgrade). The only viable way now is to cancel your MM2H Visa of the current category and re-apply for a new category. However, you are allowed to change your category prior to the endorsement of your first MM2H Visa and having paid for all the non-refundable fees to the Government.

Q2: I am a single parent (divorcee). Can I bring my child with me on a MM2H Dependent Pass?

YES, you can apply as a single parent who is a divorcee, provided that you can submit the proof of full child custody right, the child’s certified Birth Certificate and your certified Divorce Certificate, if applicable. If requested, you may also need to provide an Authorization Letter by the bio-father of your child in your MM2H application.

Q3: I am single when I apply for my MM2H. Can I add on my new spouse as dependent if I get married in the future?

YES. You can bring in your spouse later during your MM2H participation as an Add-On Dependent application. You will need to submit a certified copy of your Marriage Certificate as proof of relationship.

Q4: I am not married but my life partner and I have been living together for a long time. Can I apply for the MM2H Dependent Pass for my partner?

NO. You must be legally married to your spouse (with the official Marriage Certificate as proof of relationship) in order to apply for the MM2H Dependent Pass for your life partner.
Note: Same sex marriage is not recognised and accepted by Malaysia Government.

Q5: I was a Malaysian before and now a citizen & passport holder of another country. Can I still apply for the MM2H Program?

YES. You can apply for the MM2H Programme using your current foreign passport of another country. There is no explicit barring or disadvantage of MM2H application to any ex-Malaysians.

Q6: I have a Malaysian spouse. Can I still apply for the MM2H Program as a main applicant on my own?

YES. You can independently apply to the MM2H Program as the main applicant. In the event you divorce with your Malaysian spouse in the future after you have endorsed with your MM2H Pass/Visa, its validity status will not be affected by your divorced status.

Q7: I am unable to obtain a Letter of Good Conduct from my home country due to my past criminal record. Can I still apply for MM2H?

A Letter of Good Conduct (LOGC) from the relevant government authority in your home country or country of residence is a mandatory document you must submit in your MM2H application. If you are clear from your past criminal offence which is not a major crime committed, and able to get a clear-up LOGC, your application may still be considered.

Q8: Will my pre-existing health issues affect my MM2H application?

It depends on what kind of health issues you have. Only contagious or infectious diseases or life-threatening ailments will affect your eligibility for MM2H application. MM2H participants must pass the medical checkup (performed only during endorsement) and free from these ailments - Mental Illness, Tuberculosis, Epilepsy, Chronic Asthma, Hepatitis A/B, AIDS and Leprosy. Other chronic diseases such as cancers, heart problems, high blood pressure, high cholesterol, high blood sugar, or limb disability, etc, will not affect your MM2H application and approval.

[03] FAQ On Application Process

Q1: Do I need to come to Malaysia to submit my application?

NO. You can prepare and submit your application remotely in your own country through a licensed MM2H Agent like WANDA in Malaysia. In fact, the new MM2H Program dictates that all MM2H new applications must be submitted to MOTAC through a licensed MM2H agent that you have appointed.

Q2: When do I need to come to Malaysia for my MM2H application?

You only need to make a trip to come to Malaysia, together with your dependents, when your application is approved and when you are ready to complete your endorsement (stamping of MM2H Visa sticker onto your passport), within 90 days from the issue date of your Approval Letter.

Q3: Can I submit my MM2H application on my own (DIY) without using a MM2H agent?

No. All the new MM2H applications (starting 2024) must be submitted by a licensed MM2H agent like WANDA to MOTAC One-Stop-Center (OSC). Strictly no “DIY” or self- application will be entertained by MOTAC, unlike the old policy. Contact us for assistance.

Q4: Can I stay in Malaysia on a tourist social visit visa (PLS) or Special Pass (SP) while waiting for my MM2H approval?

No. The approval process may take up to 3-4 months (or longer for complicated cases) after your submission of application. During this waiting period, you are not allowed to be overstaying in Malaysia. While you can make use of the 90-days visa-free Social Visit Pass facility given to nationals of selected countries, such as China and India, to stay in Malaysia during this period, please observe strictly the maximum 30-days per visit, re-entry constraint and overstaying regulations imposed by Malaysia Immigration. Q5: How long does the entire MM2H application process take to get my MM2H Pass/Visa eventually?

Currently, it takes up to 3 to 4 calendar months (or at least 30 working days as stated in the AP) to obtain the Approval Letter (SKB) after submission of completed documents to MOTAC OSC. Prior to the submission, the preparation of documents typically takes another 1 to 2 months (depending on your country of origin) to get ready all the necessary certified/attested documents from your country of origin. After approval, the endorsement can be completed within 1 to 2 weeks time but up to the 90-days (3 months) period given. In short, the fastest period it takes for the end-to-end process, from application to approval and endorsement, is at least 4 to 6 months.

Q6: How long must the passport be valid for my MM2H application?

All the passports must have a minimal validity period of at least 12 months. We strongly recommend you to renew your passport (if less than 2 years of validity left) for the maximum validity allowed in your country (5 years or 10 years), if necessary, prior to the submission of your MM2H application.

Q7: Does the MM2H Approval Letter have the same effect of having the MM2H Visa sticker in my passport?

NO. You can not use the MM2H Approval Letter as a Visa for your entry into Malaysia. The MM2H Approval Letter is only a "conditional approval" granted to your application. You can only get your MM2H Visa/Pass endorsed in your passport AFTER you have completed your 'Endorsement" process within 90-days upon getting your Approval Letter.

Q8: Do I need to keep my MM2H Approval Letter throughout my MM2H participation in Malaysia?

YES. You are required to provide a copy of your MM2H Approval Letter to be submitted to MOTAC OSC as the supporting document in other follow-up applications during your MM2H stay in Malaysia, such as add-on dependents, transfer of endorsement due to change of passport, FD withdrawal, extension, renewal or termination. Sometimes, this letter is also required for your children's school enrolment, new bank account opening in the banks or purchase of insurance from insurance companies. So, please keep your original MM2H Approval Letter in a safe place, just like your original birth/marriage certificates.

Q9: What is the difference between Acknowledgement Slip, Acknowledgement Receipt (AP) and Approval Letter (SKB) for my MM2H application?

Throughout the MM2H application process, you will receive 3 different official documents from MOTAC/Immigration at different phase of your application:
  • Acknowledgement Slip (Slip Pengesahan) - This is a slip generated automatically to acknowledge for successful uploading/submission of your application documents into the MM2H Online System with the platform fee paid.
  • Acknowledgement Receipt (AP or Akuan Penerimaan) - This is an official acknowledgement by the Immigration Department that your submission (both digital copy and physical copy) has been received and checked/validated for documents completeness with the issue of your future MM2H Visa reference number assigned for your case.
  • Approval Letter (SKB or Surat Kelulusan Bersyarat) - This is the official letter of conditional approval granted to your successful application with the details of “conditions” you must comply with prior to eventual endorsement of MM2H Pass sticker onto your passport.

Q10: Can I apply MM2H for principal and dependents using different MM2H agents?

No. This is not allowed by MOTAC. To ensure one set of applications (for principal and dependents) is managed by one single MM2H agency, you are not allowed to use different agencies, one for principal and another one for dependents. However, in the event you have obtained your principal approval/endorsement from one agent but decided to change to another agent for your dependents add-on application, you must first apply for the Change of Agent (and successfully obtain a Release Letter from the first agent) for the principal BEFORE you can submit your dependents add-on application using the second agent.

[04] FAQ On Documents Preparation

Q1. What kind of documents do I need to prepare for my MM2H application?

The document sets you need to prepare is determined by the number of your family members to be included as dependents in your MM2H application.

The MM2H applicant to prepare:
  • Copy of Passport (Biodata Page) for the principal / main applicant
  • Copy of Passport (Biodata Page) for the dependents, if any.
  • Passport-size photo of all participants
  • Letter of Good Conduct (LOGC) / Police Clearance Certificate (PCC) / Certificate of No Criminal Conviction (CNCC) / Criminal Record Certificate (For main applicant and all dependents, aged 18 and above).
  • Proof of family relationship (Must be translated in English and certified / attested at Malaysia Embassy/ Consulate Office in home country):
    • Spouse: Marriage Certificate
    • Children under 21: Birth Certificate or Adoption Certificate
    • Children aged 21-34: Birth Certificate or Adoption Certificate + Statutory Declaration (being single and unemployed in Malaysia)
    • Parents: Main applicant's Birth Certificate
    • Parents-in-law: Spouse’s Birth Certificate
  • Proof of Income
    • Salary Slip (for the employed)
    • Other Incomes Statement (for business owners or retirees)
    • Bank Statements
    • Employment Confirmation Letter (for the employed or business owners) or Retirement Self-Declaration Letter (for retirees)
While your appointed agent shall be responsible for preparation of the necessary Immigration forms, official cover/intent letters, resumes and other supporting documents for your MM2H application. Contact us for assistance.

Q2: What is a Letter of Good Conduct (LOGC)?

A Letter of Good Conduct (LOGC) is an official document issued by a government authority such as the police department or ministry of foreign affairs verifying that an applicant has no criminal record in their home country or country of residence. It is also known as Police Clearance Certificate (PCC, Certificate of No Criminal Conviction (CNCC) or Criminal Record Certificate in some countries. A LOGC is a mandatory document for the main applicant and all dependents who are 18 years old and above for MM2H applications. This document is submitted to the Malaysia Police Department for security clearance checking. Any persons who do not pass the Police’s security clearance, their application will be rejected and no appeals shall be entertained.

Q3: Can I submit a LOGC I obtained more than a year ago?

No. The LOGC is only valid and accepted for only six months from its date of issuance for the MM2H application process. You need to re-apply for the latest copy of LOGC from your home country or country of origin.

Q4. I have no idea how to go about getting my LOGC and the necessary certificates attested or certified in my home country. Can you assist?

YES. As your appointed MM2H agent, we will guide and assist you remotely during the crucial document preparation stage. Depending on your country of origin and your current place of residence, you may have to engage a local third party provider or agent to provide the expedited services. Contact us for assistance.

Q5: How long does it take to get ready these LOGC and certified copies of Birth/ Marriage Certificates as proof of relationships for my MM2H application?

This is dependent on your country of origin and the place you are staying now. Typically, it will take 2 to 6 weeks for preparation of the necessary documents such as LOGC or certified copies of Birth/ Marriage Certificates.

Q6: I am currently residing in Malaysia (or in another oversea country) and not in my own home country. Can I get the attestation/certification of my birth or marriage certificates in my country’s embassy/ high commission/consulate in Malaysia (or in that oversea country)?

This is dependent on your home country and consular services as provided by your embassy / high commission / consulate in the place you are staying now. If this is not viable, you may have to make a return trip back to your country of origin to obtain these certified documents. Contact us for assistance.

[05] FAQ On Properties Purchase

Q1: Is property purchase compulsory under new MM2H 2024 policy?

YES. All MM2H participants under the Silver, Gold, and Platinum categories are now required to purchase a residential property in West Malaysia within 12 months after endorsement of their MM2H Pass/Visa. While MM2H participants for the SEZ/SFZ category must purchase a residential property in Forest City of Johor State, before the endorsement of their MM2H Pass/Visa.

Q2: What is the consequence of not buying a property within 12 months after my endorsement?

MOTAC reserves the right to revoke your MM2H Pass that has been approved if you fail to submit the stamped Sales & Purchase Agreement (SPA) as a documentary proof you have fulfilled the mandatory property purchase condition in the MM2H Programme.

Q3: What type of property can I purchase to fulfill the MM2H condition?

Only residential property such as an apartment, condominium or landed property (terrace house, semi-detached or bungalow), are allowed for the MM2H property purchase. Commercial property such as shoplots, office units or factories, are not accepted as property purchase under MM2H policy. Contact us for more details.

Q4: What is the minimum value of property I must purchase with my MM2H Silver Pass?

The minimum value property you are allowed to purchase is dependent on 2 factors: your MM2H category and location (state/territory in West Malaysia). For a Silver Pass holder wishing to buy a property in Kuala Lumpur, the minimal value is RM 1 Million (determined by KL City Council for permissible foreigners’ property purchase value), not RM 600,000 (as set in MM2H Policy for Silver category). If it is in Selangor State, the minimal value is RM 2 Million and limited to Strata title property. But if you purchase a property in other states such as Melaka, Perak or Penang (certain projects only), you can purchase at RM 600,000. Contact us for more details and consultations.

Q5: What is the minimum value of property I must purchase with my MM2H SEZ/SFZ Pass?

For SEZ/SFZ Pass holders, you can only purchase a property located in Forest City only (not any other zones covered under the Johor-Singapore Special Economic Zone (JS-SEZ), and it must be a first hand property directly from the Developer, not from the resale market (second hand unit). The minimum value of residential units in Forest City (aka developer’s units) start from RM 500,000 and above, depending on availability.

Q6: When do I need to purchase my property, before or after my MM2H application? *

Either way is allowed with conditions. Typically, you are allowed to purchase your property after your MM2H application, within a 12 month grace period after the endorsement date of your MM2H Pass. But if you have purchased your property, years before your MM2H application, it is also allowed to be considered as having fulfilled the mandatory property purchase. However, for property purchased more than 2 years ago before your MM2H endorsement, you are not allowed for partial FD withdrawal.

Q7: Can I buy a completed property from the resale (second-hand) market, or a unit under construction directly from the property developer?

YES, you are allowed to buy a completed property from the resale (second-hand) market directly from the seller or through a property agent (REN), or a unit under construction directly from the property developer. **With the exception of the SEZ/SFZ category.

Q8: Can I purchase more than one residential property with my MM2H status?

YES, you can. MOTAC does not explicitly limit or disallow the MM2H participants to purchase more than one residential property under MM2H policy. Like any foreigners in Malaysia, you can purchase more than one residential property in Peninsular Malaysia, as long as the property value is approved by the respective State Authorities (Land Office).

Q9: Can I sell off my property under MM2H ?

There is a condition in the new MM2H policy which only allows you to sell off your MM2H property after a 10-year locked-in period. However, you are allowed to sell off the first unit within the 10-year period, as long as at the same time, you purchase a second unit that is higher value than the first one. Also, upon termination of your MM2H participation, you can apply to sell off your property in Malaysia.

Q10. Can I lease out my first property purchased under MM2H but I rent another unit to stay in another State?

Currently, there are no explicit regulations by MOTAC barring such practice, which may be necessary to some MM2H parents, due to proximity and travelling convenience of children's schools nearby or change of school for their children. Advisable to seek for further clarification from MOTAC. Contact us for more advice.

[06] FAQ On Fixed Deposit

Q1: When do I open my MM2H FD bank account in Malaysia?

You can only open your FD bank account for your MM2H application after you have received your MM2H Conditional Approval Letter (SKB) issued by MOTAC OSC, not during the application period.
Note: Without the MM2H approval letter, most of the banks do not allow you to open any bank account as a foreigner. But there are very few local banks which may consider pre-approval bank account opening but are subject to certain restrictions and requirements. Please contact us for more details on this matter.

Q2: Which local bank am I allowed to open my MM2H FD bank account with?

You can open your FD account in ANY local or international commercial banks which are registered and licensed in Malaysia. It is your own choice of preference for the bank you choose. Please contact us for recommendations.

Q3: What does it mean that my MM2H FD account must be tagged LIEN?

Your MM2H FD account is tagged LIEN by the bank, meaning the bank disallows you to withdraw any amount or close this account WITHOUT the prior approval obtained from MOTAC. For any FD withdrawal, you MUST submit your application to MOTAC OSC and obtain an approval letter for withdrawal. Please contact us for assistance.

Q4: When can I withdraw my MM2H fixed deposit?

You can withdraw your fixed deposit (up to maximum of 50%) as soon as you have completed your endorsement, for approved expenses such as property purchase, children’s education, medical and local travel in Malaysia. At any time, you must have at least 50% balance of the stipulated amount kept in your MM2H FD. You can only withdraw all of your FD balance upon a voluntary termination of your MM2H participation by yourself or a forced revocation of Pass by the Malaysia Immigration due to a violation of the conditions as set forth in your Approval Letter.

Q5: How can I withdraw partially from my MM2H Fixed Deposit (FD) account?

Withdrawals are on a reimbursement basis - you pay the expenses first, then withdraw later. To apply for withdrawal, you must provide the relevant supporting documents to your appointed agent for the application :
  • Property Purchase: Stamped Sale & Purchase Agreement and partial payment receipts [up to 50% of FD value even if you have paid less than this amount for your property in your receipts combined]
  • Medical: Medical receipts issued by local clinics, medical centers or hospitals [up to the total value of receipts combined]
  • Education: Student fees receipts [up to the total value of receipts combined]
  • Tourism in Malaysia: Travel-related receipts such as accommodation, flight tickets, food & entertainment expenses, booking fees, etc. [up to the total value of receipts combined]

Q6: I bought a residence in Malaysia before my MM2H application, can I still withdraw 50% of my Fixed Deposit for the purpose of property purchase?

Yes. You are allowed to withdraw up to 50% of your FD for the residence you have purchased not more than 2 years ago BEFORE the endorsement of your MM2H Pass.

Q7: Can I withdraw the interests earned from my fixed deposit each year?

YES. You can withdraw the interests earned on your fixed deposit each year for personal use. However, you must apply for approval to withdraw from MOTAC. Contact us for assistance.

Q8: Can I withdraw the balance of my fixed deposit if I terminate my MM2H or if it is revoked by MOTAC?

YES. You can withdraw the full balance of your FD once you have applied for the approval letter from MOTAC for terminating your MM2H Pass/Visa voluntarily, or if it is revoked by MOTAC for whatever reasons. Contact us for assistance.

[07] FAQ On Employment, Investment & Business

Q1: Can I work or be employed in Malaysia with my MM2H Pass?

YES and NO. Only the MM2H Platinum Pass (Principal only) holder is allowed to work in Malaysia (meaning being employed by a Malaysia-registered company, locally-owned or foreign-owned). The main applicants of other categories (Gold, Silver and SEZ/SFZ) or ALL the MM2H Dependent Pass holders are NOT allowed to work or be employed in Malaysia. This is clearly stated in the MM2H Visa sticker - "Any form of employment is strictly prohibited".
Warning: If you are holding a MM2H Pass with "Any form of employment is strictly prohibited" printed, and you are found to be working or employed in a Malaysia company, even on a freelance or part time basis, you are considered having violated the Immigration Law. You risk having your MM2H Pass (including your dependents) to be revoked by the Malaysia Immigration and may be subject to any other penalties governed under the Immigration Act.

Q2: The MM2H Platinum Principal Visa holders are allowed to work and do business in Malaysia. What about their dependents? Can they do the same?

NO. Only the main applicant or principal of a MM2H Platinum Visa is allowed to work in Malaysia (meaning being employed by a Malaysia company, or running his own business in Malaysia). The dependents of Platinum category are NOT allowed to work in Malaysia, just like other categories. This is stated clearly in the dependent MM2H pass sticker - "Any form of employment is strictly prohibited".

Q3: Can a MM2H Platinum Visa holder work in a professional practice such as lawyer, doctor or architect, in Malaysia?

While a MM2H Platinum Pass holder (main applicant) is allowed to work or be employed in Malaysia, he/she must have a relevant professional qualification and accreditation, recognized by the respective professional bodies in Malaysia, to practise as an architect, doctor, lawyer, pharmacist, engineer, accountant, etc. in Malaysia. Please consult the respective professional bodies for more details.

Q4: I am a MM2H Silver Pass holder. I have just got a local employment offer from a Malaysian company. Can I work in Malaysia?

Being a MM2H Silver Pass holder (main applicant or dependent), you are NOT allowed to work in Malaysia, full time or part time. However, you can choose to take up a new Employment Pass (EP) in order to work in Malaysia but you MUST terminate your MM2H Pass first.
Note: If a principal MM2H Pass holder terminates/cancels his MM2H Pass, all the Dependent Passes of his family members are automatically terminated also !!

Q5: I have registered a company in Malaysia (Sdn Bhd) as the shareholder and director. But I am not actively running the business. Have I violated the “work in Malaysia” condition of my MM2H Pass?

If you are a MM2H Pass holder of the Gold, Silver or SEZ/SFZ category, you are considered having violated the "Any form of employment is strictly prohibited" condition in your Pass. Being a director of your own company is considered as an employment in Malaysia, even if you draw zero salary or any other director benefits-in-kind from the company payroll.

Q6: Can I invest in a public listed company counter in Bursa Malaysia or in a private owned company (Sdn Bhd) as just being a shareholder or investor?

Receiving a dividend from your investment or shareholding in a public-listed company or privately owned company is not considered as an employment in Malaysia. However, we advise you to write to MOTAC OSC Helpdesk for further confirmation. Contact Us for assistance.

Q7: I am still working remotely for my business in my home country. Am I considered “working in Malaysia” and affect my MM2H Pass?

No. The condition of "Any form of employment is strictly prohibited" in your MM2H Visa sticker only applies to any employment within the territory of Malaysia with any Malaysia registered employer and receive an income paid in Malaysia (which may include contributions to EPF, SOCSO and IRD). Please refer to the Employment Act of Malaysia.

Q1: Can I enrol my children to study in any of Malaysia's public schools?

NO. Public schools (or government schools) in Malaysia are not open to any foreigners, with the new policy enforced by the Ministry of Education (MOE). However, you can enroll your children in any private schools or international schools in Malaysia.

Q2: Do I need to apply for another Student Pass for my children who are now holding MM2H Dependent Pass to enrol in local international schools?

NO. With MM2H Dependent Pass, you can enrol your children (below 18 years old) to enrol in any international schools in Malaysia, as it is accepted as a long term pass. You only need to apply and obtain an additional "Permission to Study" stamping from MOTAC, in addition to the MM2H Dependent Pass of your children. Contact Us for assistance.

Q3: Is there any advantage to enrolling my children into the top ranking international schools with the MM2H Dependent Pass?

YES. Most of the top-ranking and popular international schools in Malaysia only accept foreign children who already possess a Malaysia Long Term Pass such as MM2H Pass, Employment Pass, Residency Pass or Diplomatic Pass as the prerequisite for enrolment. Holding a short term Social Visit Pass is not accepted by these schools for admission purposes.

Q4: My child is reaching 18 years old and about to enter Pre-U / A-Level or tertiary level. Can he continue to use the MM2H Dependent Pass for enrolment into the local college or university?

Once your child (dependent) has reached 18 years old and has received an Offer Letter from the school, college or university for a Pre-U / A-Level / Diploma or Tertiary level study in Malaysia, he/she is required to cancel the existing MM2H Dependent Pass and request the school to apply for a separate Student Pass from Education Malaysia Global Services (EMGS). YES. [09] FAQ On Taxation

Q1: Do I have to pay taxes in Malaysia on the incomes/funds I remitted abroad?

NO. As a MM2H participant, it is tax-exempt on the incomes/funds remitted from abroad to Malaysia (by the Inland Revenue Board of Malaysia). However, you must have cleared any taxes due in your country of origin or overseas country of your tax residency.

Q2: Do I pay any taxes while living in Malaysia as a MM2H participant?

Yes. When you spend money for any goods or services in Malaysia, you are still subject to paying the applicable Sales and Services Tax (SST), like any Malaysian residents. You are also required to pay the Stamp Duty (for foreigners) for your purchase of property in Malaysia.

Q3: Do I automatically become a Malaysia tax resident after I obtain my MM2H?

NO. You do not automatically become a Malaysia tax resident upon becoming a MM2H participant. You need to apply separately from LHDN if you wish to. Contact us for assistance.
Note: For a foreigner to become a Malaysia tax resident, he must have resided in Malaysia for more than 182 days and with incomes earned in Malaysia. Consult the tax consultants who specialize in taxation for foreigners for further assistance.

Q4: Can I import my car from my home country duty-free after I obtain my MM2H?

NO. You must pay the import duties to the Malaysia Customs for importing your car(s) from your home country into Malaysia, even if you are a MM2H participant now. The old MM2H policy which allows duty-free import of cars from your home country is no longer applicable in the new MM2H policy.

Q5: I have invested into a second property in Malaysia and rented it out. Do I have to pay any income tax?

Yes. Rentals you earn are considered as passive incomes and subject to income tax, if your minimal thresholds for taxable personal income are exceeded.

Q6: I am selling off the first property I purchased under MM2H. Do I have to pay the capital gains taxes?

Yes. You have to pay the related Real Property Gain Tax (RGPT) for selling off your property purchased under MM2H for a profit. Consult your property/taxation agent for the applicable RGPT rate applicable for foreigners.

Q1: I am married to a Malaysian spouse and now holding a Malaysia Spouse Pass. Can I apply MM2H?

Yes. You can independently apply for MM2H as the principal yourself. However, you must cancel your existing Spouse Pass before you can endorse for your new MM2H Pass.

Q2: I am graduating from a Malaysia university and my Student Pass is expiring soon. Can I apply MM2H?

Yes. As long as you are aged above 21 years old (for SEZ/SFZ category) or 25 years old (for Platinum, Gold or Silver categories), and able to fulfill the financial and other requirements as specified in MM2H Programme, you can apply for MM2H Pass as the principal immediately after your graduation. Your existing Student Pass must expire or be shortened before you can endorse for your new MM2H Pass.

Q3: Can I convert my driving license in my home country into a Malaysia driving license?

YES. The new JPJ (Road Transport Department) policy only allows holders of Diplomatic Pass and MM2H Pass (but limited to principal and spouse only**) for automatic conversion of their home country driving license (not International Driving License) into a Malaysia driving license, without having to retake the full tests and driving courses applicable for all foreigners.
