Property purchase is a MANDATORY condition in the New MM2H Policy. All successful applicants of MM2H Platinum, Gold and Silver categories are REQUIRED to purchase a residential property (a completed unit from the resale market, or a unit under construction directly from any property developer, located in ANY State in Peninsular Malaysia) within 12 months from the endorsement date of their MM2H Passes, while SEZ/SFZ category applicants must purchase a residential property directly from the developer of FOREST CITY in Johor BEFORE endorsement of their MM2H Passes.

Notes:
The minimum value is also determined by the threshold set for foreigner purchase in the respective State or Federal Territory. For example, it is at least MYR 1 Million for property in Kuala Lumpur (with foreign consent from DBKL), while it is MYR 500,000 in Melaka. The higher price shall prevail between the minimum value set by the State and by the MM2H policy. Hence, property search becomes an important and time-consuming task for all MM2H applicants.

Is property purchase compulsory under the new MM2H 2024 policy?
YES. All participants under the Silver, Gold and Platinum categories must purchase a residential property in West Malaysia within 12 months after endorsement of their MM2H Pass/Visa. SEZ/SFZ category participants must purchase a residential property in Forest City, Johor, before endorsement.
What happens if I don't buy a property within 12 months after endorsement?
MOTAC reserves the right to revoke your approved MM2H Pass if you fail to submit the stamped Sales & Purchase Agreement (SPA) as proof you have fulfilled the mandatory property purchase condition.
What type of property can I purchase to fulfil the MM2H condition?
Only residential property — apartment, condominium or landed property (terrace, semi-detached or bungalow). Commercial property such as shoplots, office units or factories is not accepted. Contact us for details.
What is the minimum property value I must purchase with my MM2H Silver Pass?
It depends on two factors: your MM2H category and the location (state/territory). For a Silver holder buying in Kuala Lumpur, the minimum is MYR 1 Million (set by KL City Council for foreigners), not MYR 600,000 (the MM2H Silver policy figure). In Selangor it is MYR 2 Million and limited to strata-title property. In other states such as Melaka, Perak or Penang (certain projects only), you can purchase at MYR 600,000. What is the minimum property value for my MM2H SEZ/SFZ Pass?
SEZ/SFZ holders can only purchase a property in Forest City (not other zones of the Johor-Singapore Special Economic Zone), and it must be a first-hand property directly from the developer, not resale. Minimum value of Forest City developer units starts from MYR 500,000 and above, depending on availability.
When do I need to purchase my property — before or after my MM2H application?
Either is allowed with conditions. Typically you purchase after your application, within the 12-month grace period after endorsement. If you bought a property years before applying, it can also count as fulfilling the condition. However, for property purchased more than 2 years before your endorsement, you are not allowed partial FD withdrawal.
Can I buy a completed resale property, or a unit under construction from the developer?
YES, you may buy a completed resale property directly from the seller or via a property agent (REN), or a unit under construction directly from the developer — with the exception of the SEZ/SFZ category.
Can I purchase more than one residential property with my MM2H status?
YES. MOTAC does not explicitly limit purchasing more than one residential property. Like any foreigner in Malaysia, you can purchase more than one residential property in Peninsular Malaysia, as long as the value is approved by the respective State Authorities (Land Office).
Can I sell off my property under MM2H?
The new MM2H policy only allows selling your MM2H property after a 10-year lock-in period. However, you may sell the first unit within the 10 years as long as you simultaneously purchase a second unit of higher value. Also, upon termination of your MM2H participation, you can apply to sell your property.
Can I lease out my MM2H property but rent another unit to stay in a different state?
Currently there are no explicit MOTAC regulations barring this, which may be necessary for some MM2H parents due to proximity to children's schools. It is advisable to seek further clarification from MOTAC. Contact us for advice.
